If the dispute cannot be resolved through negotiation within 30 days, either party may elect to submit the dispute to binding arbitration in accordance with the rules of a recognized arbitration organization. The arbitration shall be conducted in English, and the arbitrator's decision shall be final and binding.
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, government actions, or network failures.
Provisions that by their nature should survive termination shall survive, including but not limited to ownership, warranty disclaimers, indemnification, and limitations of liability.
